Amendments to the Connection Agreement, GTC to the Connection Agreement, Provider Connection Agreement and to Price List to the Connection Agreement, Provider Connection Agreement and STPIP/QTPIP Connection Agreement: Clarifications on on-site audits

Eurex Circular 055/21 Amendments to the Connection Agreement, GTC to the Connection Agreement, Provider Connection Agreement and to Price List to the Connection Agreement, Provider Connection Agreement and STPIP/QTPIP Connection Agreement: Clarifications on on-site audits


1.   Introduction

The Executive Board of Eurex Frankfurt AG decided the following:

a.  Update of the “Agreement on the technical connection and the utilization of the Electronic Trading System of Eurex Deutschland” (hereafter: Connection Agreement) regarding the decommissioned offering of ISE-Order-Routing-Services of Eurex Clearing AG

b.  Clarification of the “General Terms and Conditions to the Agreement on the technical connection and the utilization of the Exchange-EDP of Eurex Deutschland” (hereafter: GTC Connection Agreement) and the “General Terms and Conditions to the Agreement on the technical connection of a Multi-Member-System Provider to the Exchange-EDP Eurex®“ (hereafter: GTC Provider Connection Agreement) regarding on-site audits

c.  Update of the “Price List to Connection Agreement, Provider Connection Agreement and STPIP and QTPIP Connection Agreement” (hereafter: Price List) regarding the decommissioned offering of “Intraday Volatility Forecast” and Standard and Qualified Third-Party Information Provider (STPIP and QTPIP) offerings

These amendments will come into effect on 2 August 2021.

2.   Required action

The attached amendments are deemed to have been approved if the Trading Participant does not lodge objections with Eurex Frankfurt AG within six (6) weeks of notification of the amendments.

3.   Details

A. Update of the Connection Agreement following the decommissioning of ISE-Order-Routing-Services of Eurex Clearing AG

Eurex Frankfurt AG (EFAG) is removing the offering for ISE-Order-Routing-Services of Eurex Clearing AG from the Connection Agreement due to the decommissioning of this service.

B. Amendments with regard to on-site audits

In order to provide more clarity on the on-site audit process, EFAG is adding a clarification to the GTC Connection Agreement and to the GTC Provider Connection Agreement:

Potential consequences regarding on-site audit findings, i.e., that EFAG may temporarily halt the operation of the affected technical infrastructure and only recommence the operation as soon as orderly conditions are restored. Fees will continue to apply during halt. EFAG will notify the affected participant about the decision on a temporal halt in written form with a minimum of five working days in advance of the halt.

C.  Amendments with regard to the decommissioning of the “Intraday Volatility Forecast” offering and clarification of services for STPIPs and QTPIPs


EFAG is removing the offering for “Intraday Volatility Forecast” from section 1.4 of the Price List due to the decommissioning of this service. Also, clarifications to section 3 are provided on offerings to STPIPs and QTPIPs.
