MiFID II/MiFIR: Obligation to comply with transaction reporting requirements for Trading Participants outside the scope of MiFIR

Eurex Circular 111/23 MiFID II/MiFIR: Obligation to comply with transaction reporting requirements for Trading Participants outside the scope of MiFIR

1.   Introduction

With this circular, we would like to draw the attention of Trading Participants outside the scope of the MiFIR regulation (“non-MiFIR Trading Participants”) to the mandatory compliance with the requirements for transaction reporting pursuant to § 66 Exchange Rules of Eurex Deutschland (Exchange Rules), in conjunction with Eurex Circular 146/17

2.   Required action

The data required for transaction reporting must be provided completely and correctly via the Regulatory Reporting Solution (“RRS”). At the beginning of the business day following the trading day (T+1), RRS will provide each non-MiFIR Trading participant with a file containing all transactions , which must be enriched with further information and re-uploaded via Common Upload Engine (“CUE”) latest by 18:00 CET/CEST on T+1. An incomplete or not timely delivery of required data, taking into account “non-MiFIR reporting known limitations”, constitutes a violation of the Exchange Rules.
