1.  Introduction

As announced and further explained in Eurex Clearing Circular 009/26: Effective 2 March 2026, the ‘capacity group’ for selected Equity Index Derivatives will be reclassified in accordance with the clearing requirements of sec.871(m) IRC1 derivatives transactions cleared by Eurex Clearing AG (Eurex Clearing) and its role as reporting party in front of the IRS (U.S. Internal Revenue Service).

The corresponding new ‘capacity group’ for each of the products in scope is outlined in the Attachment.

2.  Required action

Participants that have open positions or are interested in trading the products outlined in the table above should take the changes in Eurex Clearing Circular 009/26 into account.

Please note that the entering into transactions relating to the products outlined in the Attachment are subject to the compliance with regulatory and withholding tax-related obligations (particularly U.S. tax withholding obligations and reporting requirements under sec.871(m) IRC derivatives transactions). For more detailed information, please refer to Eurex Clearing Circulars 009/26 and 046/24.
