1. Introduction
As part of Eurex Clearing AG’s maintenance and continuous development with regards to compliance and the management of associated risks, Eurex Clearing AG would hereby like to remind all Clearing Members of the necessity to apply adequate compliance measures in connection with the usage of Eurex Clearing infrastructure, products and services by Clearing Members and their representatives.
2. Required action
The usage by a Clearing Member, Clearing Agent, ISA Direct Clearing Member or ISA Direct Light License Holder (or their representatives) of the infrastructure, products and services provided by Eurex Clearing AG must not infringe or contribute to the infringement of any criminal laws, including criminal tax laws, applicable to it or its representatives. Adequate criminal compliance measures must therefore be applied in connection with the usage of Eurex Clearing AG’s infrastructure, products and services. Where Clearing Members offer clearing services to clients, Clearing Members must in addition ensure that their compliance measures adequately avoid a misuse of Eurex Clearing AG’s infrastructure, products and services by their clients.
Clearing Members are further expected to closely follow developments regarding sanctions to ensure full compliance with governmental sanctions and restrictive measures as and when they are imposed. Clearing Members are in particular expected not to use the infrastructure, products and services of Eurex Clearing AG in a way that would contravene sanctions and or embargos imposed by the relevant authorities.
Unless the context requires otherwise, terms used and not otherwise defined in this circular shall have the meaning ascribed to them in the Clearing Conditions or FCM Clearing Conditions of Eurex Clearing AG, as applicable.
